Momentum Web provides custom website design, development, hosting, maintenance, and related services as described on momentumwebagency.com.

Free Website Draft

We offer a free draft website before a customer chooses to proceed.

The draft is for preview purposes only. Ownership of the website design and code remains with Momentum Web at all times, regardless of payment status.

Subscription Model

Our websites operate on a monthly subscription fee of $100/month (the Momentum Care Plan), billed automatically through Stripe. No long-term contracts — your plan is month-to-month and you may cancel anytime.

The subscription includes:

• •Premium hosting (no separate fees)
• •Weekly automated backups
• •Security monitoring and updates
• •Unlimited minor edits (text changes, image swaps, content updates)
• •Performance optimization and monitoring
• •SSL certificate management
• •24/7 support access

Website Ownership & Intellectual Property

Momentum Web retains full ownership of all website designs, layouts, code, structure, and proprietary elements created for your website.

Clients receive a non-exclusive, revocable license to use the website for as long as their subscription remains active. Subscription payments do not grant ownership of the website.

You do not own the website design or code unless you purchase a buyout (see Buyout Option below).

If the subscription is canceled or payment stops (after the 30-day grace period), the website will be suspended at the end of the paid period.

Clients who wish to take their website elsewhere may request an export of static files for a one-time migration fee. Exported files do not include ownership of the underlying code or design unless a formal buyout is purchased.

Buyout Option

Clients may purchase full ownership of their website design and code for a one-time fee of $2,500. Upon buyout, Momentum Web will transfer static files and ownership of the design structure to the client.

The buyout includes:

• •Transfer of static website files
• •Ownership rights to the design structure
• •Design and code ownership transfer

The buyout does NOT include:

• •Hosting services
• •Maintenance or updates
• •Security monitoring
• •Future edits or support
• •Any ongoing services

After buyout, the client is responsible for all hosting, maintenance, security, and future development. The subscription will be cancelled upon completion of the buyout transaction.

Client Responsibilities

Clients agree to:

• •Provide accurate content and business information
• •Ensure any content they supply does not infringe on intellectual property
• •Respond in a timely manner during design and deployment
• •Keep payment information up to date to ensure uninterrupted service

Payment Terms

• •Monthly payments of $100 are processed automatically through Stripe
• •You receive a 30-day grace period if payment fails. We will not take any action on your website for 30 days, giving you time to resolve payment issues
• •No refunds are offered for monthly subscription payments (see Refund Policy)

Revisions & Scope

Unlimited minor edits are included in your subscription. This includes text changes, image swaps, content updates, and small tweaks.

Larger changes such as new pages ($100 each), full redesigns ($500), custom CMS systems ($500), or new integrations may require an additional fee. All pricing is upfront with no hidden fees.

Cancellation

You may cancel your subscription at any time with no penalties or fees. No contracts or commitments are required. We believe in earning your business every month.

When you cancel:

• •Your website will remain active until the end of the paid monthly period
• •No further charges will occur
• •The site will be taken offline at the end of the billing cycle

If you wish to take ownership of your website, you must purchase a buyout (see Buyout Option section above) before you cancel your subscription.

Liability Limitations

Momentum Web is not liable for:

• •Loss of revenue
• •Business downtime
• •Third-party service issues
• •Client mistakes or unauthorized access

We provide websites "as is" and make every reasonable effort to keep them secure and reliable.

Governing Law

These terms are governed by the laws of New York State.
